Attorneys Lawrence G. Pugh III and William W. Sentell III successfully confirmed an arbitration award in the United States District Court for the Eastern District of Louisiana. In the original arbitration, Mr. Pugh and Mr. Sentell defended their client, Planet Beach Franchising Corporation, against claims brought by two Minnesota-based franchisees. The franchisees, who were represented by Dady and Gardner, P.A., had sought rescission of four franchise agreements and some $2.4 million in statutory damages. The four-day trial was held in October 2014. The arbitrator dismissed all of the franchisees’ claims and awarded Planet Beach $444,871.25 in damages and attorney’s fees. The franchisees then sought to vacate the award, arguing that the damages they were ordered to pay violated Minnesota law. The federal district court in New Orleans rejected those claims and entered judgment in favor of Planet Beach in accordance with the arbitration award.
