Attorneys Stephen W. Brooks, Jr., and Richard J. Voelker successfully defended an appeal of a judgment entered in a state worker’s compensation case. In the original proceeding, in which Mr. Brooks and Voelker served as trial counsel, an administrative law judge determined that an employee had forfeited his rights to all worker’s compensation benefits after it was determined he was intoxicated when he was injured at work. The judge ordered the employee to repay the employer’s insurer $296,029 in benefits and attorney’s fees. The Louisiana First Circuit Court of Appeal affirmed the judgment with one minor modification.
