PUGH ACCARDO Successful in Defense of Insurer on Cross Employee Exclusion

In an asbestos personal injury matter, Ben Ward and Larry Pugh represented the insurer of Decedent’s employer. Insurer issued a series of commercial general liability policies to employer in the 1960s and 1970s. Insurer maintained that coverage did not extend to employer because of the employee exclusion. Additionally, insurer maintained that the claims against the “executive officers” were also excluded because of the “cross employee exclusion” contained in the policies. The trial court granted summary judgment to insurer and plaintiff appealed arguing that the cross employee exclusion was ambiguous. The 1st Circuit Court of Appeal affirmed the trial court’s ruling, finding that the policy language validly excluded claims against the employer and executive officers.
